General Terms and Conditions

These General Terms and Conditions of purchase and sale via the online shop www.babybareshoes.sk are issued by:

(hereinafter referred to as the “General Terms and Conditions”).

 

PART I 

Article I 

General Provisions

 These General Terms and Conditions govern the legal relationship between the seller and the buyer arising from the sale and purchase of goods ordered by the buyer from the seller by one of the methods specified herein, including delivery, acceptance of the ordered goods, and payment for the ordered goods.

By submitting an order, the buyer confirms that they have read and understood these General Terms and Conditions, agrees to them, and confirms that the information provided in the order is true and complete. 

The Seller is the Baby Bare Shoes store, operated by Barefootovo s.r.o., with its registered office at Rumančeková 18, 821 01 Bratislava, Slovak Republic, Company ID: 50144782, VAT ID: SK2120189313 (hereinafter referred to as the “Seller”). 

The Buyer (Customer) is a natural person with full legal capacity who has ordered goods from the Seller. The Buyer is the proposer of the contract with the Seller.

 An Order means an order of goods placed by the Buyer with the Seller via the online shop www.babybareshoes.sk, by email, or by telephone.

 Goods mean all products offered in the online shop www.babybareshoes.sk. 

Article II

 Ordering Goods

 The Buyer may place an order via the online shop www.babybareshoes.sk, by email, or by telephone.

 Each order must contain:

Natural person: first and last name, permanent address, delivery address (if different), phone number, name of goods, quantity, price, payment method, and preferred delivery method.

An order that does not contain all the required information under Article II(2) may not be accepted by the Seller.

 Orders are processed in the order in which they are received.

 The Seller will confirm the order by email or telephone and inform the Buyer of the expected delivery time. If the ordered goods are not currently in stock, the Buyer will be informed via SMS, phone call, or email and notified of the estimated delivery date. If the Buyer does not agree with the delivery date, they may withdraw from the purchase. Withdrawal must be notified to the Seller no later than 48 hours before dispatch. After this period, order cancellation will not be accepted.

If the price of the goods increases by more than 1% compared to the price listed in the online shop, the Seller will notify the Buyer, who then has the right to withdraw from the purchase contract.

Article III 

Delivery and Acceptance of Goods

 The Seller is obliged to deliver the goods within the agreed time and to the agreed place as confirmed in the order pursuant to Article II(5).

 Delivery methods:

• SPS courier service – cash on delivery or prepayment to bank account; estimated delivery time 2–14 days (depending on stock availability / receipt of payment).

 Delivery times stated are indicative only. The binding delivery time is the one agreed upon during order confirmation.

 Shipping and handling costs:

• SPS courier, prepayment: €2.90
• SPS courier, cash on delivery: €3.60
• Slovak Post, registered mail (2nd class), prepayment: €1.80
• Slovak Post, registered mail (2nd class), cash on delivery: €2.50
• International prepayment: €5.90
• Zásilkovna.cz pick-up point, prepayment: 90.79 CZK
• Zásilkovna.cz pick-up point, cash on delivery: 109.71 CZK

The Buyer is obliged to accept the goods at the agreed place and time.

Upon receipt of the shipment, the Buyer must inspect the package for damage and completeness and confirm acceptance on the delivery note. Later complaints regarding quantity or physical damage will not be accepted.

 Article IV

 Price, Payment Method, and Transfer of Ownership

 The price stated in the online shop www.babybareshoes.sk is final and binding.

 Payment methods:

• Bank transfer
• Cash or card payment at pickup 

For non-cash payments, the purchase price is due within 5 days of concluding the contract. For deliveries outside the Czech Republic and Austria, payment must be made in advance by bank transfer.

 Ownership of the goods transfers to the Buyer only after full payment of the purchase price.

Article V

 Personal Data Protection

 Personal data are processed in accordance with Act No. 18/2018 Coll. on the Protection of Personal Data.

 The operator does not provide personal data to third parties except employees, selected delivery companies, state authorities in case of inspection, or contractual processors.

The operator is obliged to secure personal data against unauthorized access and ensure confidentiality. 

The data subject has rights under Sections §19 et seq. of Act No. 18/2018 Coll., including the right to information, access, correction, erasure, restriction, objection, data portability, and the right to lodge a complaint with the supervisory authority.

 The operator processes the following personal data: title, first name, last name, address, delivery address, billing address, phone number, and email address for order processing and accounting purposes. Data are stored for 10 years. 

PART II 

Complaints Policy

 Article VI

 Subject of Complaint

 The subject of a complaint may be goods purchased from the Seller.

 The Seller is not liable for defects caused by improper use, non-compliance with instructions, unauthorized modifications, use of non-original accessories, or natural material wear.

Article VII

 Complaint Conditions

 The warranty period is 24 months unless stated otherwise.

 A receipt or invoice must be provided when making a complaint.

A complaint form (“Formular_reklamacia_vratenie 2025”) must be completed.

Warranty repairs are free of charge and must be completed within 30 days. 

Article VIII

 Withdrawal from Contract, Exchange of Goods

 The Buyer has the right to withdraw from the contract within 14 days of receipt of goods.

 Withdrawal must be notified by email to info@babybareshoes.sk, stating the order number, variable symbol, purchase date, proof of purchase, and bank account number.

 Returned goods must be sent back by registered mail (not cash on delivery).

 Refunds will be processed within 14 working days. Return shipping costs are borne by the Buyer.

 PART III

 Final Provisions

 Article IX

 Matters not governed by these Terms and Conditions are subject to applicable Slovak law, especially the Civil Code.

 Invalidity of any provision does not affect the validity of the remaining provisions.

 The Seller reserves the right to amend these Terms and Conditions without prior notice.

 Article X

 If the Buyer fails to collect an order placed via www.babybareshoes.sk, the Seller reserves the right to charge a contractual penalty of €15. An invoice will be issued and payable within 14 days.

 If the Buyer cannot collect the shipment, they are obliged to contact the Seller by phone.
